In accordance with the legal responsibilities defined by the Law on Local Self-Government, respectively Article 86, which supervises the activity of the municipalities of the Republic of Kosovo, the Ministry of Local Government Administration has drafted the Report January-June 2021, regarding the assessment of legality of acts of municipal assemblies for this period. MLGA has submitted to the Government the report in accordance with Article 12 of Regulation (GRK) No. 10/2019, on Administrative Review of Municipal Acts with which MLGA is responsible for coordination and periodic and annual reporting on the supervision of municipal acts.
According to this report, in the period January-June 2021, the Municipal Assemblies of the Republic of Kosovo have approved a total of 1034 acts, of which 58 regulations and 976 decisions, where 632 acts were evaluated by the MLGA, while 402 acts were sent to the line Ministries. These acts are part of the legal obligations of municipalities and are required to be in full compliance with applicable law.
The Ministry of Local Government Administration, after assessing and reviewing the legality of acts in municipalities, has assessed 585 acts as legal, while it has returned 47 acts for review to municipalities, thus those municipalities after receiving the request for review have reviewed and harmonized 30 acts as requested by the MLGA, while 17 acts remain unreviewed, whereas for 1 act a letter was sent to the MoJ to send it in court as it has not respected the review deadline, 3 acts were suspended after the announcement of local elections by the President of the Republic of Kosovo, as defined by the legislation in force as the decisions were related to the exchange of municipal property, while 13 other acts are within the legal deadline for review by municipal assemblies.
With regards to the acts sent to the line Ministries, MLGA has sent to these ministries 402 acts for review of which 335 acts have been confirmed as legal whereas 66 have been found to be illegal.
In 38 municipalities of the Republic of Kosovo, the municipal assembly meeting have been held regularly, the meetings were open to the public. With the aim of supervising their work, they were monitored through the telepresence system as well as through direct participation in the assembly meetings, respectively in the Municipal Assembly of North Mitrovica, Leposavic, Zubin Potok, Zvecan and Novoberd.
