In the Parliamentary Committee for Public Administration, Local Government, Media and Regional Development, two important draft laws for local government have been approved in principle.
Minister Krasniqi, in his speech, emphasized that MLGA, based on its legal mandate, drafted the law for the administrative review of municipal acts. While, mentioning that the review of the legality of acts has so far been based only on regulations, while now this process will have the relevant law.
Minister Krasniqi added that “This draft law has defined which acts are included in the category of acts which are subject to mandatory review, which acts are subject to regular review and which acts are subject to suitability review, as well as the terms on which the supervisory bodies will make the assessment”.
Additionally, the draft law for the allocation for use and exchange of immovable municipal property has been drafted by the working group. The drafting of this draft law came about as a result of the difficulties that followed the implementation of this law.
The drafting process of this Law was preceded by the drafting of the ex-post evaluation of the law. The purpose of the evaluation was to identify the reasons how the Law was implemented, and whether prior actions were undertaken by the institutions responsible for the implementation of this Law.
In 2023, the Government of Kosovo has approved the concept document for the allocation for use and exchange of the municipal immovable property.
Regarding this law, Minister Krasniqi emphasized that “This is an important law for the municipalities and other parties involved, because it aims to ensure the effective use of the immovable property of the municipality for sustainable economic development, the increase in the value of the immovable property of the municipality and fulfilling the general interest”.
During the drafting process of these draft laws, all the legal procedures foreseen, regarding the drafting of the draft laws, were respected.
