LEGAL DEPARTMENT AND MONITORING OF THE MUNICIPALITIES

1.Duties and responsibilities of the Legal Department and Monitoring of the Municipalities, are to:

1.1.Provide legal support on drafting strategic and legislative documents in the scope of ministry;

1.2.Provide assistance on drafting the primary and secondary legislation in the scope of ministry;

1.3.Ensure compliance with techniques and standards on drafting the legislation in the scope of ministry;

1.4.Ensure approximation of the ministry legislation with the legislation of the European Union (acquis communautaire) and with the applicable laws in Kosovo;

1.5.Provide legal advice and recommendations in regard to the scope of ministry as required;

1.6.Cooperate with the Ministry of Justice for representation of the ministry in court proceedings;

1.7.Monitors the work of municipal bodies including the executive and the legislative;

1.8.Monitors the implementation of the legislation on local self-government and municipal acts, after the  request for review;

1.9.Develops and maintains electronic municipal governance platforms;

1.10.Monitors respecting and protection of human rights and provides support to the municipality with regards to respecting of human rights;

2.Head of the Legal Department and Monitoring of the Municipalities reports to the Secretary General.

3.The following Divisions are part of this Department:

3.1.Division of Drafting and Harmonisation of the Legislation;

3.2. Division for Monitoring Legislation Enforcement, Legal Support and Inter-Institutional Cooperation in the field of Legislation;

3.3.Division for Monitoring of Municipalities;

3.4.Division for Advancement of Human Rights.

4.Number of employees in the Legal Department and Monitoring of the Municipalities is twenty seven  (27).
