Regarding the allocation of municipal property for use, we clarify that the Ministry of Local Government Administration from the first moment has treated with maximum attention the Decision of the Municipality of Prishtina for the long-term allocation of municipal property for use. We also inform the public that the MLGA has not annulled or returned for reconsideration this decision, but has requested clarification and additional documents which are missing.
Given the fact that local institutions have been consolidated with a delay due to the electoral process, the MLGA at the beginning of this year has allowed all municipalities, including Pristina, to announce the list of properties that would be allocated for use, until March 31, 2022. Therefore, the decision of allocation for use of municipal property to “The Sunny Hill”, by the negotiation procedures of the Mayor, was approved by the Municipal Assembly of Prishtina on 10.05.2022, while it is received for review of legality in the Ministry on 16.05.2022.
Although the case was not completed, considering the importance of such an activity, MLGA in accordance with the competencies under the Law on Local Self-Government for the administrative review of municipal acts has requested additional clarifications regarding the decision of the Municipality of Prishtina, with emphasis especially for the duration of the commissioning and the fact that the parcel is 17 hectares, as requested to be allocated for use, and a part of which has the status of agricultural land. In addition to this case there were some essential documents that were missing in the application for which MLGA also requested additional clarifications:
a) The project submitted by the investor and the dynamic investment realization plan;
b) Bank turnover for the previous year, as provided by Article 23 of Regulation (GRK) no. 09/2020 on setting the procedures for allocating for use and exchange of immovable property of the municipality.
MLGA wants to emphasize that for this act and the method of giving the property for use for 99 years, the MLGA has received feedback from civil society organizations which have drawn attention to exactly how this process was proceeded. Yet MLGA has been and continues to be committed to treating the act in question with interest and seriousness. Currently our Ministry is waiting for an answer to the questions we have sent to the Mayor of the Municipality of Prishtina, Përparim Rama.
Taking into account the importance of any major investment and the need for serious projects, but always following the procedures as provided by laws and regulations, and also in accordance with the interest and manner of use of public property, we inform you that we are in the process of reviewing this act and it is not a matter of cancellation by the ministry.
